
On July 14, 2019, rioters violently attacked anti-riot police at New Town Plaza in Sha Tin, resulting in multiple injuries to police officers including one officer who had his ring finger bitten off by Hong Kong University graduate To Kai-wa. On the July 8, the Department of Justice filed three cases in the District Court seeking compensation from To Kai-wa and three others for employee compensation already paid to four police officers injured on duty. Two of the claims are for approximately HK$1.98 million and HK$106,000, respectively.
The plaintiffs in the three cases are all from the DOJ, with To Kai-wa as the defendant in the first case. The claim states that two employees, Senior Superintendent Leung Chi-kin and Detective Inspector Leung Kai-yip, were injured on duty on July 14, 2019, due to actions taken by To Kai-wa. Therefore, under Section 25 of the Employees’ Compensation Ordinance and Section 15 of the Pension Benefits Ordinance, the DOJ is seeking to recover employee compensation already paid, additional pensions awarded due to injury, related interest, and legal costs, although the claim does not specify the amount sought.
In the second case, the defendants are Leung Pak-tim and Lee Man-him. The claim states that government employee Cheung Lik-hang was injured around 10 pm on July 14, 2019, while working at New Town Plaza Phase 1, with his injuries caused by the two defendants. The DOJ is seeking a total of HK$1,980,355.5 for Cheung's employee compensation and related legal costs.
The third case lists Leung Pak-tim and Gong Zhi-yuan as defendants, stating that another government employee, Kwok Siu-hang, was also injured on the same day and location, with his injuries attributed to the two defendants. The DOJ is now seeking HK$106,745.99 for Kwok's employee compensation from both individuals.
