Tariff war fuels counterfeits: Lululemon sues Costco for patent infringement. (DDN)

Canadian yoga and activewear brand Lululemon has filed a lawsuit in a U.S. court, accusing Costco of selling low-priced replicas of its popular apparel, thus infringing on its patent rights. With rising inflation and a trade war affecting consumers, the demand for counterfeit luxury items has surged on social media.

In a 49-page legal document submitted to a California court, Lululemon claims Costco is selling counterfeit versions of its Scuba hoodies, Define jackets, and ABC pants, some under Costco's Kirkland label. Lululemon argues these actions violate its patents and exploit its brand reputation. The Vancouver-based company is seeking a court order to stop Costco from selling these products and to remove all related promotional content. Additionally, Lululemon is requesting damages for its losses.

North American consumers, facing inflation and tariffs imposed by the previous administration, are increasingly turning to lower-priced counterfeits. Social media has promoted these replicas as trendy choices, with users sharing their finds. Neither Costco nor Lululemon has commented on the lawsuit. A Lululemon spokesperson noted that rising tariffs have increased operational costs, leading the company to negotiate with suppliers to reduce expenses and lessen the impact on consumers.
