Departure of several overseas judges does not weaken HK judiciary, says Chief Justice

In recent months, the resignation of some overseas non-permanent judges from Hong Kong's Court of Final Appeal has drawn public attention. At the Opening of the Legal Year 2025 on January 20, Chief Justice Andrew Cheung addressed the issue, noting that rising geopolitical tensions have significantly impacted the judiciary. He condemned the organized harassment and pressure faced by some overseas judges, making their roles increasingly politicized. Cheung emphasized that any fair assessment of the situation must consider the broader context of geopolitical tensions.

Currently, the Court of Final Appeal has six overseas non-permanent judges: two from the United Kingdom and four from Australia. Cheung stated that overseas judges have long symbolized Hong Kong's commitment to legal excellence and judicial independence. While it is regrettable that some judges have decided to step down, their decisions should be respected. However, their departure does not compromise the quality or independence of the judiciary.

Cheung acknowledged that recruiting overseas judges with equivalent status and experience may become more difficult due to current geopolitical challenges. Nonetheless, the Court of Final Appeal continues to have highly respected overseas and local non-permanent judges who work alongside full-time judges. This demonstrates the court's enduring strength and resilience in facing challenges.

Cheung stressed that Hong Kong's legal system is built on strong legal principles, precedents, and a robust operational structure. Hong Kong judges are well-trained, experienced, and fully capable of upholding the rule of law, a fact that continues to be consistently proven.
